Customer Terms & Conditions

1. Who we are and when these Terms apply
3693 Cards is operated by SINCE3693 Limited, 2 Frederick Street, Kings Cross, London, WC1X 0ND, United Kingdom (“we”, “us”). Contact us at [email protected]. These Terms apply to an account, Individual profile, Team workspace, digital service, subscription, add-on or card purchase when the applicable customer has accepted this version. The description and price shown for a particular order or plan form part of that transaction. Our Privacy Policy explains our own use of personal data. The Customer Data Processing Agreement at https://3693.cards/dpa applies where we process customer-directed personal data for a customer and that agreement has been accepted in the appropriate capacity. Neither document is permission for unrelated visitor analytics or marketing.
Public profiles can be viewed without an account or age gate. An Individual customer contracts in their own capacity. A Team customer is the organisation identified by its owner; only the Team owner may accept these Terms and the DPA for that organisation. An administrator or invited member does not bind it merely by joining or managing a profile. Members remain responsible for their own account use. A person who publishes an unclaimed guest profile acts only for that temporary profile, not for a future account or Team; a later claimant must separately accept the agreements applicable to continued use. Acceptance does not verify anyone's age, capacity or authority.
2. Eligibility, accounts and Team authority
To accept these Terms or buy a product, you must have legal capacity under the law applicable to you and, if acting for an organisation or another person, authority to bind or represent them. A person without the required capacity or authority must not accept or purchase on someone else's behalf. This does not restrict public viewing. Give accurate account and billing information, protect your sign-in method, use available security controls and report suspected unauthorised access promptly. We remain responsible for our own service and security duties.
A Team chooses its owner, administrators, members and profile permissions. Its owner must keep authority and access current, remove access no longer needed and make sure people acting for it follow these Terms. We enforce the roles offered by the service. A change of Team owner does not make the new owner the person who accepted an earlier version; the new owner must accept any agreement required to bind the Team going forward.
3. Profiles, content and publication
You retain your rights in material you supply. You give us a non-exclusive licence to host, technically format, copy, transmit and display it only as needed to provide the features you select, including public profiles, cards, Wallet passes and exports. That licence ends when the relevant material is removed from our active service, subject to lawful retention, backups and copies others have already made. We do not take ownership of your content.
Before publishing, you must have authority to use the identity, contact details, portraits, logos, portfolio, files, links and claims involved; provide legally required information to represented people; and keep content accurate. A published profile may be visible to anyone, indexed or copied outside our control. If you supply information about a child, you must have lawful authority and consider the child's interests and rights. You must not publish more than necessary or use the service for unlawful targeting of children.
The existing per-profile Agent Creation Terms confirmation and its historical acceptance evidence remain valid for the publications to which they applied. Once these Customer Terms are accepted, these Terms govern ongoing account and service use. The Agent Creation Terms continue to supply compatible profile-publication obligations, but these Customer Terms prevail for a conflict about future service use, consumer rights, refunds, data protection or liability. Earlier acceptance records are not rewritten or attributed to a different person.
4. Customer-directed information and acceptable use
A profile owner or Team decides why it publishes a profile, collects enquiries, scans business cards, uses leads and bookings, and follows up. It must identify its own lawful basis, provide required notices, honour rights and marketing law, limit access and keep records only while necessary. It must review at least yearly whether each lead, booking, network contact and associated conversation still serves a legitimate business purpose, and instruct earlier deletion when it does not or a valid right requires it. Keeping an account open does not itself justify indefinite retention. This yearly review is the customer's responsibility.
Do not treat a visitor's contact confirmation as consent to unrelated tracking or marketing. Do not use leads or reports for unlawful surveillance, discrimination, harassment or unsolicited marketing, or sell visitor information without lawful authority. Do not impersonate people, publish unlawful or infringing material, upload malware, use deceptive links, bypass access controls, scrape at harmful scale or disrupt the service. We may proportionately restrict content or access for a serious breach, security risk or legal requirement; where feasible and safe, we will explain the action and offer a way to raise a concern. These customer obligations do not remove our own controller, processor, security or product-design responsibilities.
5. AI, Calendar, Wallet and analytics
AI replies, lead assessments and business-card extraction can be wrong. Review outputs before relying on them, especially for consequential decisions. A suggestion by an assistant is not a completed lead submission or booking; the visitor must complete the relevant action. Do not use AI or analytics for unlawful profiling or regulated decisions without the safeguards and authority that law requires. Reports are based on recorded events and may be affected by device changes, blocked storage, fraud controls or outages; they are not guaranteed counts. We remain responsible for analytics purposes and collection methods that we determine ourselves.
Google sign-in is separate from optional Google Calendar connection. A connecting owner authorises the requested Calendar permissions for calendar selection, availability and event creation. The Privacy Policy explains the data involved, disconnection and revocation. The owner should maintain accurate availability and address changes with attendees. Apple and Google Wallet, Calendar and payment services depend on third parties and devices. Their interruptions may affect features, but this clause does not exclude our duties or your mandatory remedies.
6. Prices, subscriptions and add-ons
Before an order, we show the product or plan, total price or calculation, currency, recurring interval, promotion, taxes, shipping and material conditions that apply. Optional charges require your agreement. A subscription or independently billed add-on renews on the disclosed interval unless cancelled or law requires otherwise. A price or material feature change will be notified as required by law, with any required cancellation or refund remedy. We may correct an obvious pricing error before accepting an order; we will not charge a higher amount without your agreement.
Ordinary cancellation stops future renewal. Subject to the conditions of the purchased feature, access continues to its paid-through date. A paid-first bonus-month offer extends the first paid period as disclosed at purchase; ordinary cancellation preserves access through that extended paid period. A Team add-on requires an active paid Team base plan. Cancelling the base plan stops future add-on renewals, and the add-on becomes unavailable when the base paid period ends even if the add-on has a later paid-through date. A customer does not give up a mandatory remedy merely by buying or cancelling an add-on.
We do not offer discretionary or goodwill refunds for subscriptions or add-ons. This does not limit a statutory withdrawal right or a remedy for a faulty, misdescribed or undelivered service. Use the available cancellation tools or contact [email protected]. Refund and statutory-rights requests go to that address; there is no general self-service refund flow. Payment is confirmed by the payment provider and our verified records, not simply by returning from Checkout.
7. Virtual and physical cards; consumer withdrawal
Basic and customisable virtual cards, and standard and personalised physical cards, are supplied according to the description, options, price and delivery information shown before purchase. We do not offer discretionary or goodwill refunds. Applicable statutory withdrawal rights and remedies for faulty, misdescribed or undelivered goods, digital content or services remain available.
For a UK or EU consumer buying at a distance, the ordinary change-of-mind period is 14 days. For a standard physical card, it starts when you or a person you name receives it; if one order arrives in parts, it normally starts when the last part arrives. For a subscription, other service or virtual-card digital content not supplied on a physical medium, it normally starts when the contract is made. Any longer period or different mandatory rule in the law that applies to you prevails. This is separate from your rights if something is faulty, misdescribed or not delivered.
A physical card genuinely made to your specifications or clearly personalised may fall within a legal exception to change-of-mind withdrawal; we must explain that before purchase where required. Merely choosing from a standard design does not establish the exception. Whether a virtual card is digital content, a service or a combination depends on what is actually supplied. Immediate supply and acceptance of these Terms alone do not end a withdrawal right. We do not currently rely on a loss-of-withdrawal exception that requires separate express consent, acknowledgement and durable confirmation for early digital supply or completed services. If you expressly request a service to start during the cooling-off period and then withdraw, the law may permit a proportionate charge for the service supplied, subject to its information and request requirements.
To withdraw, send a clear statement to [email protected] or to SINCE3693 Limited at the registered address above before your applicable deadline. Give your order reference and enough information to identify the order. You may use the model form below, but you do not have to. Sending the notice before the deadline is sufficient. Ordinary cancellation of a future subscription renewal is different from exercising a statutory cooling-off right; tell us if you mean to withdraw from the current contract.
For eligible goods, send them back within 14 days after telling us you withdraw, unless we offer to collect them. Contact support for the return address or collection instructions. We pay return costs for faulty or misdescribed goods where law requires it. For a change-of-mind return, you bear only the direct return cost if we gave you the legally required information before purchase and have not agreed to pay it; otherwise we bear that cost. We may make a lawful deduction for handling beyond what is needed to inspect the goods. We reimburse the product price and the cost of our least expensive standard delivery option, not an extra charge for a premium delivery option you chose. We use the original payment method unless you agree otherwise and will not charge a refund fee.
For a valid UK withdrawal from a service or digital-content contract, we reimburse without undue delay and within 14 days after the day we are told of your withdrawal, subject to any lawful proportionate service charge. For eligible UK goods that we do not collect, we reimburse without undue delay and no later than 14 days after the day we receive the goods back or you provide evidence that you sent them back, whichever is earlier. If we offered to collect the goods, the 14 days run from the day we are told of your withdrawal. For an EU withdrawal, reimbursement is due without undue delay and no later than 14 days after we are told of the withdrawal; where we have not offered to collect goods, applicable law permits withholding it until we receive the goods or evidence of return, whichever is earlier, after which we act without undue delay. We do not impose a minimum waiting period or start a new discretionary 14-day period. Any different mandatory rule that applies to you prevails.
Model cancellation form (optional): To SINCE3693 Limited, 2 Frederick Street, Kings Cross, London, WC1X 0ND, United Kingdom; [email protected]. I give notice that I withdraw from my contract for the following goods, digital content or service: [describe order]. Ordered on: [date]. Received on, if goods: [date]. Consumer name: [name]. Consumer address: [address]. Date: [date]. Signature: [only if sent on paper].
For a fault, misdescription or non-delivery, contact [email protected] with your order reference and the issue so we can assess the statutory remedy promptly. Where a UK statutory refund for goods, digital content or a service is due, we give it without undue delay and within 14 days beginning with the day we agree you are entitled to that remedy. We will not delay that assessment merely to postpone the deadline. Other applicable mandatory remedies and deadlines prevail. No clause above removes a mandatory right because work has started or a product was customised.
8. Suspension, ending service and data
You may stop using the service and cancel eligible renewals through available billing tools or by contacting us. We may suspend or end service for serious breach, non-payment, legal requirement or material security risk, giving notice and a chance to remedy where feasible. Urgent action may be immediate. We will apply any legally required continuation or refund remedy if we end a paid service without your breach.
Owners can use available exports for certain leads and bookings and request further return, access or deletion through [email protected]. There is no single complete self-service export or account-deletion process. On closure, we assess outstanding subscriptions, orders, Team authority and requests; arrange return or deletion of customer-directed data under the applicable DPA; and retain financial, audit or other records only where justified by law or legitimate claims. Backups, provider copies and public copies held by others may require separate handling. The Privacy Policy describes current limitations; these Terms do not promise instant erasure from every copy.
9. Liability and disputes
We will provide the service with reasonable care and skill. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, deliberate misconduct, or any liability or mandatory consumer, data-protection or other right that law does not allow us to limit. A consumer may recover losses that are a reasonably foreseeable result of our breach, subject to applicable law; no business-only monetary cap below applies to a consumer.
For a business customer, our total contractual liability for ordinary direct loss arising in any 12-month period is limited to the greater of £5,000 and twice the fees paid or payable for the affected service in that period. This cap does not apply to the excluded liabilities above, our confidentiality or data-protection duties, or a remedy that cannot lawfully be capped. Neither party is liable to the other for a loss that was not reasonably foreseeable when the contract was made, except for fraud, deliberate misconduct or another liability that cannot be excluded. The customer is responsible for claims caused by its unlawful content or instructions only to the extent of its own fault; we do not ask it to indemnify us for our negligence or breach. A court or regulator may apply mandatory rules regardless of this allocation.
Please first raise a complaint at [email protected] so we can investigate. English law governs these Terms for business customers, with the courts of England and Wales having jurisdiction. A consumer may also rely on mandatory protections and courts available under the law of their habitual residence; this choice does not take them away. These Terms do not replace any statutory complaint or dispute route.
10. Changes and document precedence
We may revise these Terms prospectively with appropriate notice. A material revision requires a new acceptance where law or the service's agreed process requires it; merely visiting a page is not acceptance. The version applicable to an earlier transaction remains identifiable. For customer-directed processing, an accepted DPA prevails over these Terms on a data-processing conflict. Mandatory law prevails over both. If one provision is unenforceable, the remainder applies as far as law permits.
